This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

The applicant has been arrested in connection with Crime No. 57/2019 registered at Police Station- Excise Circle Saraipali, District- Mahasamund (C.G.) for the offence punishable under Section 34(2), of C.G. Excise Act. 3.

Case of the prosecution, in brief is that on 24.01.2019 10 bulk liters of hand made liquor has been seized from the possession of the applicant. 4.

Govt. Advocate submits that two criminal cases have been reported in the police case diary against the applicant, out of which one under Cr.P.C. another under IPC. 5.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicant furnishes two solvent sureties for a sum of Rs. 25,000/- along with a personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned, he be released on bail.. 6.
