(2) This is the third bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.908/2014 registered at Police Station City Kotwali, District Rajnandgaon, for the offence punishable under Sections 398 of the IPC and Sections 25(IB) and 27 of Arms Act.

(3) The applicant's first & second bail applications were dismissed on merit by order of this Court dated 27.07.2015 & 23.12.2015 passed in M.Cr.C. No.3543/15 & M.Cr.C. No.7624/15.

(4) After hearing learned counsel appearing for the parties and taking into consideration the totality of the facts and circumstances of the case, I do not consider it a fit case to entertain the third bail application. Consequently, the third bail application is rejected.

However, the trial Court is directed to expedite the trial as directed earlier on 23.12.2015 passed in M.Cr.C. No.7624/2015. (5) Certified copy as per rules.
