1. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant in connection with Crime No. 161/16 registered at Police Station Mahasamund (CG) for the offence punishable under Sections 420, 467, 468, 471/34 of the I.P.C.

2. As per the prosecution case, the applicant along with other co-accused has collected an amount of Rs.3,50,000/- from one Chetan to provide him job in the railways and thereafter forged appointment letter was issued. Thereby the offence has been committed.

3. Learned counsel for the applicant submits that one of the co-accused Ankur Kumar Verma has been enlarged on bail in M.Cr.C. No.5230/2017 by this Court, therefore, the applicant may also be released on bail.

4. Per contra, learned State counsel opposes the prayer for grant of bail.

5. Perusal of the bail order of the co-accused Ankur Kumar Verma in M.Cr.C. No. 5230/2017 would show that some compromise has been effected in between the complainant and the applicant Ankur Kumar Verma and certain part of the amount has been returned, therefore, the benefit of the order dated 18.09.2017 passed in M.Cr.C. No.5230/2017 cannot be made applicable in the case of the present applicant.

6. In view of the above, I am not inclined to allow this bail application. Accordingly, the bail application is dismissed. Sd/- Goutam Bhaduri Judge Ashu
