1. The limited grievance that the petitioner has raised in the present writ petition is the non-releasing of retiral dues payable to the petitioner on his retirement.

2. The petitioner herein was working under the respondents 2 to 4 and

stood retired from service on 30.06.2019. The petitioner retired from the post of Assistant Grade-III. The contention of the petitioner is that after his retirement, he has received only the amount payable under GPF account and all other retiral dues payable to the petitioner like family pension, gratuity, GIS, leave encashment etc. till date have not been finalized and settled by the department nor paid to the petitioner. Counsel for the petitioner makes a categorical submission that till the date of retirement, there has been no departmental inquiry pending against the petitioner nor was there any order of recovery or any adverse order by which the respondents could have withheld the retiral dues payable to the petitioner.

Given the aforesaid submission made by the counsel for the petitioner, the writ petition at this juncture stands disposed of directing the respondents 2 to 4 to immediately process the retiral dues payable to the petitioner and ensure that the payment of the same be made at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.

4. In case the admissible payments are not released within the stipulated period of 90 days, the entire amount shall carry interest @ 10% per annum from the date of retirement till the actual date of payment. The interest part would be recoverable from the erring officers who have not processed the claim of the petitioner promptly within the stipulated period.
