Counsel for the petitioner wants to withdraw this petition with liberty to avail the alternative remedy of filing appeal before respondent No. 2 . He, however, submits that the appellate

authority may be directed to be decided the appeal expeditiously. To which, counsel for the State has no objection. 2.

Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty. In the eventuality of filing any such appeal by the petitioner before respondent No. 2, the said authority shall decide the appeal expeditiously preferably within a period of three months from the date of filing of such appeal in accordance with law.

It is made clear that this Court has observed nothing on merits of the case and it would be for the competent authority to decide the appeal of the petitioner strictly in accordance with law.
