The applicants have preferred this first bail application under Section 439 of CrPC, as they are arrested in connection with Crime No.57/2019, registered at Police Station Farasgaon, District Kondagaon (C.G.), for the offence punishable under Sections 20 (B) (II-C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The applicants were found travelling in a car with illicit ganja weighing 52 kgs and 181 gms.

It is argued that the co-accused Deva Golari and Lalit Kumhaar have already been released on bail by this Court in MCRC No.802/2020 on 17.03.2020.

Learned State counsel would oppose the prayer for grant of bail. 5.

Considering the fact that the total quantity of illicit ganja has jointly been recovered from the present three accused persons and they are in jail since 13.07.2019, as also for the reason that the trial may take sometime due to COVID-19 pandemic related issues, this Court is inclined to release the applicants on bail. 6.

Accordingly, the bail application is allowed. The applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.1 Lakh with two sureties for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
