(1) The accused/applicant has moved this third bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No.122/2015 registered at Police Station - Dharamjaigarh, Civil & Revenue District Raigarh (C.G.) for the offences punishable under Section 379 of the Indian Penal Code and Sections 4 (1)(21) of Mines and Minerals (Deveopment and Regulations) Act, 1957.

(2) The applicant's second bail application was dismissed on merits by order of this Court dated 19.08.2015 passed in M.Cr.C. No. 4361/2015 whereas his first bail application was also dismissed on merits by order of this Court dated 02.07.2015

passed in M.Cr.C. No.3050/2015.

(3) Having heard learned counsel for the parties, having regard to the facts and circumstances of the case, I do not find any change in circumstances to entertain this third bail application, therefore, this third bail application is rejected. Certified copy, as per rules.
