This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.
The applicants have been arrested in connection with Crime No.22/2019 registered at Police Station- Hirri, District- Bilaspur (C.G.) for the offence punishable under Section 34 (2), 59(A) of Excise Act.

Case of the prosecution, in brief is that on 26/01/2019, 5.400 bulk liters of country made liquor was seized from the possession of the applicants. 5.
Counsel for the State submits that there is no criminal antecedent of the applicant is reported in police case diary.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicants furnish one solvent surety for a sum of Rs. 25,000/- each along with one personal bond of Rs. 25,000/- each to the satisfaction of the trial Court concerned, they be released on bail. 7.
