I.A. No. 1 of 2016 has been filed to condone 28 days delay in preferring the appeal.

Considering the duration, delay is condoned.

The father of the Appellant was deceased in harness on 15.11.200. It is the case of the Appellant that she applied for compassionate appointment within the time prescribed under the guidelines. The Respondents kept it pending and have rejected it on 3.1.2014 communicating that she was not eligible to be considered for the post of Assistant Teacher held by her deceased father and as she did not

possess qualification of B.Ed. and T.E.T. pass introduced subsequently on 7.2.2014.

Learned Counsel for the Appellant submits that she is willing to be considered for a Class-IV post also.

The Respondents are therefore directed to consider the case of the Appellant for compassionate appointment on a Class-IV post in accordance with law within a maximum period of four months from the date of receipt and/or production of a copy of this order.

The writ appeal is disposed.
