This is the Second Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 18.09.2019 in connection with Crime No.300/2017 registered at Police Station- City Kotwali, District Dhamtari, for the offence punishable under Sections 420, 120-B, 467, 468 of I.P.C. and Section 4, 5 & 6 of Prize Chits & Money Circulation Scheme Act, 6 & 10 of C.G. Nishchhepko Ke Hito Ka Sanrakshan Adhiniyam.

As per the prosecution case, the applicant being the Director of Suvidha Farming & Allied Company Limited, Suvidha Land developers Company & Creative India Multi State Agro Papers Cooperative Society Limited obtained an amount from the different investors on the ground that it would be doubled within a short span of time and issued a bond, however, when the bond was matured and amount was asked for, the office was closed; thereby the applicant has cheated the public at large. 3.

Learned counsel for the applicant submits that the applicant is in jail since 18.09.2019 and the similarly placed Director Pardeshi Ram Sahu has been

enlarged on bail in MCRC No.7404 of 2020 by the coordinate Bench of this Court on 22.01.2021 and the case of the present applicant is same, therefore, he may also be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail, however, he do not dispute the fact that another Director of the Company namely Pardeshi Ram Sahu has been enlarged on bail by the coordinate Bench.

Considering the fact that the similarly placed accused has already been enlarged on bail, I am inclined to release the applicant on bail. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court. Sd/- (Goutam Bhaduri) Judge Ashok
