1. The petitioner in the present writ petition was placed under suspension vide Annexure P/2 dated 10.01.2017 on account of the petitioner being involved in a criminal case under Sections 7, 13(1) (d) & 13(2) of the Prevention of Corruption Act, 1988. The said criminal case finally has resulted in the acquittal of the petitioner vide judgment dated 20.07.2018, passed by the Special Judge (Prevention of Corruption Act), Mahasamund in Special Case No. 1/2017.
2. Subsequent to the petitioner being acquitted from the criminal case, he has been approaching the authorities concerned for revocation of the suspension and for reinstating the petitioner in service, but the respondents have till date not taken any decision.
-23. Record shows that Annexure P/6 dated 19.12.2018 is also a correspondence made by the respondent No.2 recommending the case of the petitioner for his suspension to be revoked and taken back in employment, thereafter also there seems to be no further action by the respondent No.1.
4. Given the aforesaid factual matrix of the case, let the respondent No.1 take a decision in the case of the petitioner in the light of the judgment of acquittal at the earliest, preferably within a period of 45 days from the date of receipt of the copy of this order.
5. With the aforesaid observations, the present writ petition stands disposed off.
