The petitioner has assailed the legality and validity of the order passed by the SDO(R), Katghora suspending her from the ofÏce of Sarpanch of Gram Panchayat Podi, Janpad Panchayat Pali in exercise of

powers under Section 39(1)(b) of the Panchayat Raj Adhiniyam, 1993. After arguing for sometime, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to prefer an appeal against the impugned order.

In view of the above, the writ petition is dismissed, as withdrawn with the aforesaid liberty granted in favour of the petitioner. If the appeal is preferred within 30 days from today, the appellate authority shall consider and decide the same on its own merits expeditiously preferably within a period of 3 months from the date of its submission.
