S.B. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 03/09/2021 Heard.

1. The applicants are arrested in connection with Crime No.40/2019 registered in Police Station- Pasan, District- Korba (CG) for alleged commission of offence under Sections 302, 147, 148, 149 IPC.

2. This is the repeat bail application on behalf of the applicants. Their earlier bail application was dismissed on merits vide order dated 23.3.2020 passed in MCRC No.1277 of 2020.

3. Learned counsel for the applicants would press the application at this distance

-2of time mainly on the ground of delay in trial. It is stated that the applicants are in jail since 20.4.2019 and almost two and half years have elapsed but the trial has not concluded till date.

4. Taking into considering the submissions made by learned counsel for the parties, particularly taking into consideration the nature and gravity of allegation, though there is long delay, only on that ground, I am not inclined to grant bail to the applicants, but to protect the interest of the accused for expeditious trial.

5. Accordingly, the trial Court is directed to conclude the trial as early as possible preferably within a period of four months.
