The applicant has filed this application under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail apprehending his arrest in connection with Crime No.200/2017, registered at Police Station Sitapur for the offence punishable under Sections 376 of the I.P.C. and 3(2)

(5) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act.

Learned counsel for the applicant seeks permission of this Court to withdraw this application with a request that if the applicant surrenders before the Court below and files an application under Section 439 of the Cr.P.C. for grant of regular bail, then the same may be heard and decided on the same day.

Accordingly, the application is dismissed as withdrawn. However, if the applicant surrenders himself before the Court below concerned and files an application for his release, the same be heard and decided on the same day, by the concerned Court.
