Versus
1. Regional Transport Authority, Raipur Chhattisgarh
2. Regional Transport Authority, Bilaspur Chhattisgarh
3. Secretary, Regional Transport Authority, Office Of R.T.O., Bilaspur Chhattisgarh ---- Respondents For Petitioner :
Mr. Bhavesh Acharya, Advocate For State :
Mr. Somkant Verma, PL Hon'ble Shri Justice P. Sam Koshy Order on Board 06/02/2020
1. The grievance of the petitioner in the present writ petition was the inaction on the part of the respondent No.2 in not issuing a regular permit on the route Amaldiha to Dokarmana via Shyang, Barpali, Hati, Kudmara, Kartala, Nunbirra, Bhaisma, Urga, Korba, Balco, Ajgarbahar, Satrenga, Garh, Lemru, Arsena, Laampahad and one single trip daily in compliance to the order passed by respondent No.2 on 25.10.2019.
2. Be that as it may, now that since the notification dated 24.12.2019 the State Government has abolished the offices of the Regional Transport Authority at different regional levels and have now appointed the Transport Commissioner himself to act as the regional transport authority for the entire State, it is the respondent No.1 who will now have to pass an order in the light of the new provisions of law.
3. Given the fact that respondent No.2 had already on 25.10.2019 passed an order so far as grant of regular permit to the petitioner is concerned, let
respondent No.1 take an appropriate decision on the said order dated 25.10.2019 passed by the respondent No.2 at the earliest preferably within a period of 45 days from the date of receipt of copy of this order.
4. It shall be the responsibility of the petitioner to apprise respondent No.1 so far as order passed by this Court is concerned.
5. With the above observation/direction, the petition stands disposed of. Sd/- (P. Sam Koshy) Judge Rohit
