Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 18/03/2020 Heard.

1. The applicant has been arrested in connection with Crime No.878 of 2019 registered at Police Station- Kotwali, District Durg (CG) for the alleged commission of offence under Section 420, 467, 468, 471, 34 of IPC.

2. Case of the prosecution is that the land of deceased Mansingh was fraudulently subjected to an agreement of sale by the present applicant and another co-accused. The role of the applicant as alleged by the prosecution is that along with other accused, the applicant is the one who impersonated deceased Mansingh and got sale deed prepared.

3. Learned counsel for the applicant submits that in the present case, the allegation against the applicant is not prima facie made out. He further submits that in the present case, the main accused, even according to the prosecution case, Naveen Kumar Jain and Shishlal Verma, have already been granted bail by this Court in MCRC No.7592 of 2019 & MCRC No.8395 of 2019, at this stage, when investigation is complete, charge-sheet has been filed, the applicant may also be granted bail.

4. On the other hand, learned State counsel opposes the bail application and submits that the applicant is one of the main accused because allegation is

-2impersonating Mansingh is on the present applicant and he got his photographs affixed in the agreement stating himself to be Mansingh.

Taking into consideration the submission of learned counsel for the parties, particularly taking into consideration that the investigation is complete and charge-sheet has been filed and another co-accused Naveen Kumar Jain and Shishlal Verma have been granted bail in MCRC No.7592 of 2019 & MCRC No.8395 of 2019 and there is no material to show that the applicant is likely to abscond or tamper with the prosecution witnesses, the application of present applicant is also allowed on similar terms and conditions as ordered in the other case that the applicant be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one solvent surety for the like amount to the satisfaction of the trial Court for his appearance before the said Court as and when directed till the disposal of the trial.
