1. Pikan Mandal S/o Shri Prasad Chand Mandal, aged about 23 years (as per the rejection order), R/o L.I.G. 40 Amlidih Raipur Christian Colony Raipur, Tahsil And District Raipur Chhattisgarh. ---- Applicant

Versus

1. State Of Chhattisgarh Through Station House Officer, Police Station New Rajendra Nagar, Raipur District Raipur Chhattisgarh ---- Respondent For Applicants Mr. Akhand Pratap Pandey, Advocate For Respondent /State Mr. Sudeep Agrawal, Dy. Adv. General For Objector Mr. Prasoon Agrawal, Advocate Proceedings through Video Conferencing Hon'ble Mr. Justice Prashant Kumar Mishra Order On Board 24/6/2020

1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.330/2019 registered at Police Station New Rajendra Nagar, Raipur, for offence punishable under Section 406 of the Indian Penal Code.

2. Applicant had hired Eon Car bearing registration No.CG-04-LP1489 from the complainant and later on he sold the vehicle to one Ankit Chourasiya without consent of the complainant.

3. Learned State Counsel and learned counsel appearing for the objector would oppose the prayer for grant of bail.

4. Admittedly, name of Ankit Chourasiya has already been registered and the vehicle has been transferred in his name. There appears dispute about the transaction because transfer of vehicle is not possible unless the previous owner executes the sale letter and other documents in favour of the purchaser.

5. Considering the entire facts situation of the case, this Court is inclined to release the applicant on anticipatory bail.

6. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (a) he shall make himself available for interrogation by a police officer as and when required;

(b) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
