1. The accused/applicants have preferred this second bail application under Section 439 of the Code of Criminal Procedure for releasing them on regular bail during trial in

connection with Crime No.15/2020 registered at Police Station - Gidhouri-Tundra, District Balodabazar, Bhatapara, C.G. for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substance Act, 1985.

2. First bail application of the applicants was rejected on 17.08.2020.

3. After hearing learned counsel for the accused/applicants, considering the quantity of ganja 36.300 kgs. which is more than the commercial quantity and in view of the provisions contained in Section 37(1)(b) of the N.D.P.S. Act, 1985, I am not inclined to admit the second bail application and to release the applicants on bail. However, learned Special Judge (N.D.P.S.) is directed to conclude the trial expeditiously.
