1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 436/2017 registered at Police Chowki Birjher, P.S. Kurud, Distt. Dhamtari (C.G) for the offence punishable under Sections 304(B), 34 of IPC.

2. As per the prosecution case, on 18.09.2017 one Vimla has died in unnatural circumstances by fire. She was married to Parasmani Sahu on 09.05.2016. She died unnatural death within 7 years and the prosecution case is that demand of dowry was made by the present applicant and others, consequently, the incident happened.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated.

4. Per contra, learned State Counsel opposes the bail application.

5. Perused the statement of Rekha Bai Sahu and Chunnu Ram Sahu, mother and father of deceased.

6. Considering the statements of mother and father of deceased, I am not inclined to extend the benefit of section 439 of the Code of Criminal Procedure. Accordingly, this bail application is rejected.
