1. Heard on prayer for setting aside ex parte judgment of this Court.

2. Learned counsel for the applicant submits that non appearance on behalf of the applicant at the time when the case was heard and decided, was not deliberate. It is submitted that as the counsel was engaged in other Court, he could not come nor any arrangement could be made.
