1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.294/2015, registered at Police Station Telibandha, Raipur, Distt. Raipur for the offence punishable under Sections 420, 467, 468 and 471 read with Section 34 of the IPC.

2. Case of the prosecution, in brief, is that the applicant and coaccused Amit Pandey obtained Rs.8 lakhs for securing employment to complainant Vikram Singh in the offices of the Government of India and thereby committed the offence.

3. Learned counsel for the applicant submits that the applicant has not committed any offence, he has been falsely implicated in the case, no amount has been transferred in the account of the applicant, it is Amit Pandey who has obtained money and there is no evidence to implicate the present applicant in the offence in question. The

applicant is in jail since 17-8-2015 and charge-sheet has been filed.

4. Whereas, learned State counsel opposes the application and submits that the present applicant has taken the complainant to Delhi and introduced him to Amit Pandey and made false promise to secure employment for the complainant and obtained Rs.8 lakhs.

5. I have heard learned counsel for the parties and perused the case diary.

6. Taking into consideration the nature and gravity of offence, facts and circumstances of the case and evidence available against the applicant with regard to obtaining money from the complainant, I am not inclined to grant bail to the applicant. Consequently, the application is rejected.
