Advocate Hon'ble Justice Shri Gautam Chourdiya Order on Board 21/06/2021 1) The matter is heard through Video Conferencing. 2) This is the Second Bail Application filed under Section 439 of Code of Criminal Procedure, 1973 for grant of bail. The First Bail Application i.e. MCRC 9101/2020 was dismissed as withdrawn on 15/12/2020.

3) The applicant is arrested on 19/09/2020 in connection with Crime No. 541/2021 registered at Police Station City Kotwali, District Mungeli (C.G.) for the offence under Section 363, 366, 376(3), 450/34 of the Indian Penal Code, Section 4 of POCSO Act and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

4) The prosecutrix, a minor girl aged about 13-14 years, alongwith her father is present in person through video conferencing and they have no objection to release of the applicant on bail but learned counsel for the applicant seeks to withdraw this bail application with liberty to file afresh application as and when occasion arises.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
