NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Criminal Revision No.163 of 2015 Ramlal, aged about 36 years, S/o Ram Prasad, Caste Satnami, R/o Village Kalmibhata (Near Tilkeja) Chowki Urga, P.S.Korba, District Korba (C.G.) ---- Applicant

Versus

Smt. Sarita Bai, W/o Ramlal, aged about 31 years, Caste Satnami, R/o Village Kalmibhata Chowki Urga, present resident of Uchchbhatthi, P.S.Champa, District Janjgir-Champa (C.G.) ---- Non-applicant For Applicant :

Shri Avinash Mishra, Advocate.

Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 13/08/2015 (1) Heard on admission.

(2) By the impugned order under Section 127 of the Code of Criminal Procedure, 1973 (for short 'the Cr.P.C.'), the Family Court, Janjgir, District Janjgir-Champa by its order dated 24.01.2015 passed in Misc. Criminal Case No.120/2014, has enhanced allowance for maintenance from Rs.2000/- to Rs.4000/- per month. (3) Learned counsel appearing for the applicant submits that the enhancement made is shockingly high and there is no basis to make such an enhancement.

(4) The Family Court after taking into consideration the facts and

circumstances of the case and taking into account the earlier order dated 03.03.2012; and further taking into consideration the cost of living & price-index; and the basic needs of the non-applicant/wife, enhanced monthly allowance for maintenance from Rs.2000/- to Rs.4000/- and further considering the fact that the applicant is working as Village Project Extension Officer and getting sufficient salary to make payment of it, I do not find any illegality in the impugned order warranting interference by this Court in its revisional jurisdiction. (5) The revision deserves to be and is accordingly dismissed at admission stage without notice to other side. Sd/- (Sanjay K. Agrawal) Judge L/-
