1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.710/2019, registered at Police Station Jamul, District Durg (CG) for the offence punishable under Section 394 of IPC.

3. The applicant along with co-accused Bittu Thakur has committed loot of Rs.1400/- from complainant Shivcharan Sahu

at about 8:30 p.m. on 23/12/2019.

4. Learned counsel for the State would submit that the case diary is not available.

5. Considering that the offence is triable by the JMFC and the trial Court has passed a detailed order dealing with all the necessary facts of the case, this Court proceeds to decide the bail application.

6. Having considered that the offence is triable by the JMFC; the applicant is in jail since 24.12.2019 i.e. for nearly 3 months and; the charge sheet has already been filed, I am of the opinion that the present is a fit case to release the applicant on regular bail.

7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
