1. This is an application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 232/2015 registered at P.S. Tamnar, Distt. Raigarh (C.G) for the offence punishable under Sections 420 IPC.

2. As per the prosecution case, the applicant who is pretending him to be the President of Chhattisgarh Vishwakarma Bhawan Sannirman Mazdur Sanghtan has collected Rs.500/- to Rs.600/- from 30-40 villagers to prepare the cards for providing them sewing machine, cycles and cash under the Government Scheme, however, no such benefits under any Scheme were provided to the persons though the amounts were collected from them and only few cards were supplied.

3. Learned counsel for the applicant submits that charge sheet in this case has been filed and all the evidence has been collected and the applicant is in jail since 09.11.2015, therefore, the applicant may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application.

5. Taking into consideration the fact that the charge sheet in this case has been filed; applicant is stated to be in jail since 09.11.2015 as also looking to the nature of offence and the degree of allegations levelled against him, I am inclined to release him on bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. He is directed to appear before the trial Court as and when directed by the said Court.
