Petitioner has prayed for a direction to the respondents to correct the gradation list, include his name in the said gradation list of State Level Employees and consider his case for promotion within stipulated time.

As on the date of filing of this petition in May, 2004, the petitioner was aged about 59 years, therefore, his present age would be 73 years. The relief clause would suggest that the petitioner has not been superseded in the matter of promotion, but his name was not included in the gradation list of State Level Employees for

which he could not be considered for promotion. 3.

The writ petition appears to have been rendered infructuous. It is accordingly dismissed as infructuous.
