Dy. GA for the State Hon'ble Shri Justice Goutam Bhaduri Order 24/08/20
1. Heard.
2. The grievance of the petitioner is that the petitioner initially was transferred on 22.05.2018 (Annexure P-5) from Masturi, District Bilaspur to Kawardha District Kabirdham. Thereafter again he was transferred on 09.07.2019 (Annexure P-3) from Kawardha district Kabirdham to District Durg and subsequent thereto on 22.08.2019 (Annexure P-4) the petitioner was transferred from Kawardha District Kabirdham to Ambikapur.
3. Petitioner, who is appearing in person, would submit that the petitioner had joined at Ambikapur as otherwise he would have been subjected to disciplinary action. He would further submit that the petitioner is going to retire on 31.12.2020 as per Annexure P-10 and only few months are left in his superannuation, therefore, the petitioner may be transferred back so that his pension papers may be prepared.
4. I have perused the documents and heard the petitioner.
5. Considering the fact that since the petitioner has already joined at Ambikapur and also taking into that only few months are left in the superannuation of the petitioner as also the petitioner prima facie appears to have suffered frequent transfer within a short span of time, the petitioner is given liberty to make representation before the respondent No.2 within a period of two weeks from today. On such representation being filed, the respondent No.2 in turn shall decide the same within a period of 45 days from the date of receipt of the representation keeping in view the date of superannuation of the petitioner as also the fact that the petitioner was subjected to frequent transfer.
6. With the aforesaid observation, the writ petition stands disposed of. SD/-Sd/-- Goutam Bhaduri Judge Ashu
