This is second bail application under Section 439 of Cr.P.C. The earlier bail application was dismissed on 15/12/2015 vide M.Cr.C. No.6539/2015.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 7927/19 registered in Police Station Range Officer South Singpur District Dhamtari (C.G.) for offence punishable under section 26 (1) of Forest Act 1927 and 3 (1) of Damages to Public Property Act, 1984.

Medical report of the applicant is perused which is attached in the case diary which shows that the applicant was treated on 14-15/12/2015 and he is mentally and physically sound to join his duties. Considered this second bail application. As the earlier bail application was dismissed on 15/12/2015 and this is repeat bail application, this court is not inclined to release the applicant on bail as no change of circumstances appears to re-consider the bail.

Accordingly, the second bail application is dismissed. However, it is observed that charge sheet if it has been filed, applicant may file regular bail application which shall be decided on its own merit. Certified copy as per rules.
