1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.148/2016 registered in Police Station Chowki Saket Thana Patharia District Mungeli for offence punishable under sections 420, 467, 468 and 471 of Indian Penal Code.
2. As per the prosecution case, a report was made by one Ram Prakash that he was holding a land bearing Khasra No.199/9 situated at village Umaria, Mantram and Jay Kumar got their name mutated on the basis of the fake proposal of Gram Panchayat. Thereafter, sold the land to one Sheikh Aslam Khan. The present applicant was working as Secretary of the Gram Panchayat, who has prepared the forged proposal. Thereby the offence has been committed.
3. Learned counsel for the applicant submits that the applicant has been
falsely implicated in this case. He would further submit that the chargesheet has been filed in this case and no further investigation is necessary, therefore, the applicant may be released on bail.
4. Per contra, learned State counsel opposes the prayer for grant of bail.
5. Considering the facts of this case, nature of evidence, which appears to be documentary in nature and further taking into that the charge-sheet has been filed in this case, I am inclined to release the applicant on bail.
6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
