The petitioner claimed ₹ 250/- as scooter allowance from respondent No.1-Company on the basis of agreement dated 6.7.89 entered into between C.G. Paper Mill Mazdoor with respondent No.1. 2.

The Labour Court has held that the petitioner has not filed and proved the said agreement dated 6.7.89 and therefore, he is not entitled for scooter allowance, which has been affirmed by the Industrial Court.

After hearing learned counsel for the petitioner at length, I am of the considered opinion that finding recorded by two Courts below are based on the evidence available on record as the petitioner has

not filed and proved the agreement dated 6.7.89 by which he is held to be entitled for said allowance.
