1. Learned Senior Advocate for the petitioner submits that in the departmental enquiry conducted by the disciplinary authority, order of censure has been passed on 10-3-2005, copy of the same has been filed along with the return. The petitioner may be allowed to prefer representation / appeal against that order before the appellate authority and the petitioner is also entitled for increment.

2. The State counsel would oppose the order passed by the disciplinary authority.

3. Be that as it may, the petitioner is at liberty to prefer appeal / representation before the appellate authority / competent authority

and in that event, the competent authority will consider and dispose of the petitioner's appeal / representation in accordance with law, expeditiously, considering the fact that the matter is old one and pending since long.

4. With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
