1. This is an application filed under Section 439 Cr.P.C. for grant of regular bail to the applicant as he is in jail since 30.01.2021 in connection with Crime No. 175//2021, registered at Police Station State Excise Flying Squared, Raipur, District Raipur(CG) for the offence punishable under Section 34(2) of the C.G. Excise Act.

2. At the outset, learned counsel for the applicant seeks to withdraw the present bail application filed under Section 439 of the Cr.P.C. with liberty to file afresh as and when occasion arises.

3. Not opposed.

4. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed as withdrawn with the aforesaid liberty granted in favour of the applicant.
