It appears that this Court had directed the respondent No.2/the Chief Municipal Officer, Municipality Gariyaband to decide the application. The said Officer having examined formed an opinion that he is not the competent authority, therefore, the matter was forwarded to the Director and the Director, in turn, has sent the mater to the Collector. The view taken by respondent No.2 appears to be a bonafide opinion with regard to the competency of the authority. Therefore, no further orders are required to be passed.

However, the spirit of the order passed earlier on 31.08.2017 required consideration of petitioner's application for grant of earned leave, since the matter has now been sent to the Collector, Gariyaband, the Collector, if he has not decided the application, should decide the same within a period of 45 days from the date of receipt of copy of this order.

The Contempt petition is disposed off.
