1. Learned counsel for the petitioner submits that the petitioner was imposed a penalty of withholding of his next promotion for a period of two years, on 17-10-2003, but after completion of two years from 17-10-2003, his case was not considered and ultimately, he was promoted in the year 2010 and in the year 2011, he retired from service and in fact, in all fairness, his case could have been considered immediately after two years from 17-10-2003.

2. None present on behalf of the respondents, though served.

3. Since the petitioner was imposed the penalty of withholding of promotion for two years by the authority, his case ought to have been considered by the respondent Board immediately after two years.

4. Be that as it may, the newly constituted Chhattisgarh State Power Transmission Company Limited is directed to consider the case of the petitioner immediately after the period of two years from 17-102003 for the post of Senior Medical Officer within three months from the date of receipt of a copy of this order, if already not considered, in accordance with law, notwithstanding the fact that the petitioner had already retired from service.

5. With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
