1. The petitioner contends that the petitioner was transferred from the Office of Deputy Registrar, Korba to Assistant Registrar Jashpur. Pursuant thereto the petitioner had filed a writ petition bearing WPS No. 8249 of 2019 and this Court on 04.10.2019 had given a liberty to file a representation. It is contended that the said representation having been filed was dismissed. It is further submitted that the petitioner's wife is also working at Government Girls Higher Secondary School, Sakri, Block Takhatpur, District Bilaspur and
as per the policy of the State the husband and wife should be kept at same place. It is further contended that the petitioner has now joined at Jashpur and prays that he may be given the liberty to file a fresh representation to post him at a near by place of Takhatpur, District Bilaspur.
2. Perusal of the documents would show that the earlier order of the High Court has not been filed and in the earlier order there has been pleading regarding the rejection of the representation which shows that in the earlier occasion the High Court have granted a liberty to the petitioner to file a representation, the same having been filed it was dismissed. Therefore, repeated representation cannot be ordered as it is the prerogative of the State to place a particular person at a particular place and it cannot be under the judicial order. The prayer to make a representation again cannot be ordered, however the petitioner shall be at liberty to move another request otherwise if so advised not under the garb of the judicial order.
