Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 0 3 / 11 /201 (1) This writ petition has been filed against the award passed by Commissioner, under Employee's Compensation Act, 1923 (hereinafter referred to as "Act of 1923") on 15.04.2004 awarding compensation to the extent of Rs.2,26,044/- along with interest.
(2) Indisputably, the impugned award is appealable under Section 30(1)(a) of the Act of 1923.
(3) Since the impugned order is appealable under Section 30(1)(a) of the Act of 1923, this petition is held to be not maintainable. Accordingly, it is liable to be dismissed. However, this will not bar the petitioner to file appeal in accordance with law.
