Learned counsel for the petitioner would submit that the petitioner has filed an application before the Tehsildar for issuance of the caste certificate and thereafter Patwari has made an enquiry and forwarded it to the Tehsildar but the Tehsildar is not accepting the application.

Learned State counsel would submit that under the Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes (Regulation of Social Status Certification) Act, 2013, as per section 3 application to be made to the SDO in FORM-1A and SDO thereafter would enquire and issue the social status certificate.

Taking into consideration the section 3 of the Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes (Regulation of Social

Status Certification) Act, 2013, the petitioner may apply to the competent authority of the concerned district in FORM-1A for issuance of social status certificate. The petitioner may alongwith the application may attach the preliminary enquiry made by the Patwari and the relevant document in support of her claim. If such application is filed within a period of 30 days before the SDO, the SDO may decide the same in accordance with the Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes (Regulation of Social Status Certification) Act, 2013 within a stipulated time.
