For the reasons stated in the application, the same is allowed. Delay in filing the instant petition is condoned. The present petition has been filed under Section 378(3) of the Cr.P.C., seeking leave to appeal.

Considering the facts and circumstances of the case, leave as prayed for by the State is granted.

Registry is directed to register the case as a regular acquittal appeal.

Mr. Jitendra Shrivastava submits that he is also appearing for respondent No.6.

As all the respondents are represented by Mr. Jitendra Shrivastava, Advocate, State is not required to pay separate PF for serving them notice.
