1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.7/2020, registered at Police Station Kasdol, District Baloda BazarBhatapara (CG) for the offence punishable under Section 409 of the IPC.

3. The applicant has committed misappropriation of different essential commodities like rice, sugar, kerosene oil etc.

MCRC No. 1170 of 2020 amounting to Rs.4,62,055/- while he was salesman of PDS Shop of Gram Panchayat Kharri, P.S. Kasdol, District Baloda BazarBhatapara (CG).

4. Learned counsel for the State opposes the bail application.

5. Considering that the applicant is a former employee of the PDS shop, aged about 72 years and is in jail since 4.1.2020 and the offence is triable by the JMFC, I am of the opinion that present is a fit case to release the applicant on regular bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
