1. By order dated 30-5-2014, the petitioner has been promoted on the post of Principal Class-II and posted at Women Industrial Training Institute, Narayanpur.

2. Learned counsel for the petitioner submits that as per Annexure P-5, at ten places, the post of Principal Class-II is lying vacant against which the petitioner has made representation for change of his posting from Narayanpur to any other ten places which has not been considered by the State in accordance with

W.P.(S)No.5482/2014 law, therefore, the State be directed to consider his representation, in accordance with law.

3. Learned State counsel submits that at Narayanpur, new Women ITI has been established and there is sanctioned post of Principal Class-II there, no one has been posted and the petitioner has been posted, therefore, the petitioner duly promoted and appointed has to work on that post.

4. Be that as it may, it is for the State Government to place competent person on the respective post which the incumbent is entitled to be posted. However, if the petitioner has made representation claiming change of posting, it is for the respondent State to consider the said representation and dispose of it accordingly.

5. It is stated at the Bar that the petitioner's representation Annexure P-7 is pending consideration before respondent No.1. Respondent No.1 is directed to consider the representation of the petitioner and dispose of the same in accordance with law, preferably within a period of 45 days from the date of production of a copy of this order.
