On due consideration of the submission of counsel for the applicant and the ground taken in the petition for his non-appearance before this Court on 22.01.2015 appears to be just and appropriate, petition for restoration of First Appeal (M) is allowed. 5.

Accordingly, First Appeal (M) No.93 of 2014 dismissed on 22.01.2015 for want of prosecution is restored to its original number and the same may be listed for hearing. 6.
