Heard on the application filed under Section 439 of the Cr.P.C. This is fourth bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 24-01-2018 in connection with Crime No.15/2018 registered at P.S. - Khallari, District - Mahasamund, Chhattisgarh for the offence under Section 302, 201, 120B and 34 of the IPC. 2.

It is submitted on behalf of the applicant that first bail application (MCRC No.2890/2018) was dismissed on merits on 25-06-2018. The second bail application filed by the applicant (MCRC No.1684/2019) was again dismissed on 01-05-2019 not finding any change in circumstances. His third bail application (MCRC No.5940/2019) was dismissed as withdrawn on 23-092019. This is fourth bail application for grant of regular bail. 3.

As submitted, so far out of 49 witnesses still 22 more witnesses are remaining to be examined by the trial Court. For the reason that the application for bail of the applicant has already been rejected on merits, therefore, I do not feel inclined to allow this application. Consequently, this application filed by the applicant for grant of regular bail is rejected. However, the trial Court is directed

-2to expedite the trial and conclude the same preferably within a period of four months from the date of this order and non-compliance of the time limit specified shall be viewed seriously.
