1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.208/2015 registered at Police Station City Kotwali, Dhamtari, District Dhamtari (CG), for commission of offence punishable under Sections 420 read with 34, 120(B), 468 & 201 of IPC.

3. The applicant has been arrested on 5.12.2017 on allegations that he and his wife Asha Gupta (co-accused) have obtained

huge amount to the tune of Rs.60 lakhs from various candidates on promise to provide them employment in the Indian Railways.

4. Learned counsel for the State would oppose the bail application.

5. Considering the fact that the applicant is in jail since last about 1 1⁄2 years; his wife (co-accused) Asha Gupta has already been released on bail in M.CR.C. No.6947 of 2016 vide order dated 30.11.2016; and completion of the trial may take some more time, I am of the opinion that present is a fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
