1. Heard.

2. Learned counsel for the petitioner submits that the alleged Resolution was passed on 16.09.2017 (Annexure P/1) in the Gram Panchayat Prankhaira and certain allegations were leveled against the petitioner. The petitioner made a complaint against such resolution to the Collector

pursuant to which an enquiry was ordered by the SDO and the Naib Tehsildar, after enquiry on 21.08.2019, opined that the resolution of the like-nature was never passed against the petitioner and information was sent to the SDO. It is stated that in the said report that Resolution was never passed, the petitioner has been subjected to humiliation. The respondent No. 4 Chief Executive Officer Janpad Panchayat should have taken cognizance of it but despite the fact, the finding of fact of fraud has come to fore that Chief Executive Officer has failed to take into such action.

3. Considering the facts and the report of the Naib Tehsildar which is placed herein with the petition, the petitioner is given the liberty to make a detailed representation to the Respondent No. 4 Chief Executive Officer Janpad Panchayat with the copy of this petition along with all the Annexures and the order within a period of three weeks. The Respondent No. 4 Chief Executive Officer Janpad Panchayat, in respect of such representation, shall adjudicate the same in accordance with the law governing the field within a period of 45 days from the date of receipt of such representation.

4. With the above direction/observation, this writ petition stands disposed of.
