Counsel appearing for the appellant seeks permission to withdraw this appeal with liberty to avail remedy by filing the proper application before the appropriate forum.

Accordingly, with the aforesaid liberty, the appeal is dismissed as withdrawn. However, if the appellant herein files application for condonation of delay, the same shall be considered by the Tribunal. The Tribunal shall also refund the mandatory amount deposited by the appellant under proviso (1) to Section 173 of the M.V.Act, to him.
