Grievance of the Petitioner is that his father was an employee of the Respondents and retired from services with effect from 31.5.2012 and though he had retired in the year 2012 his retiral dues particularly the gratuity has not been released either to his father, and in due course of time the father has expired on 4.6.2016. The Petitioner has approached the Respondent No.2 in this regard, but no decision has been taken.

However, from perusal of the record it does not show that the Petitioner at any point of time has made a written request to Respondent No.2. 3.

Be that as it may, this Court does not incline to entertain the petition any further and the same is being disposed of, with a direction that let the Petitioner approach the Respondent No.2 by making a detailed representation within 30 days from today in respect of his claim for retiral and other benefits payable to the deceased employee. In the event of such a representation being made, the Respondent No.2 shall thereafter within a further period of 90 days take a decision for settling the dues payable to the Petitioner on the retirement of the father of the Petitioner.

Needless to mention that this Court has not expressed any opinion on the merit of the claim of the Petitioner so far as his entitlement or with regard of his being the legal heir of the deceased employee. The Respondents shall take due consideration while passing appropriate order, in accordance with the rules governing the field.

With the aforesaid direction, the present writ petition stands finally disposed of.
