This is second bail application under Section 439 of the Cr.P.C. before this Court filed by the applicant for grant of regular bail. The earlier bail application of this applicant, MCRC No.5404/2019 was dismissed on merits on 04-10-2019 by this Court. The applicant was arrested on 26-07-2019 in connection with Crime No.158/2017 registered at Police Station - Ramanujganj, District Balrampur, Chhattisgarh for the offence under Section 420/34 of the IPC and Section 10 of Chhattisgarh Protection of Depositors Interest Act.

Heard learned counsel for the applicant and learned counsel for the State/non-applicant.

Prayer has been made for extension of the temporary bail granted to the applicant by order dated 25-02-2020. The term of the temporary bail has already expired, but the applicant has not surrendered before the Court and it appears that there is no condition made out in the previous order regarding surrender of the applicant. As per the argument submitted, the applicant has been unable to meet the terms of the compromise with the complainants
-2because of which he prays for extension of time. Therefore, for the present the period of the temporary bail is extended uptill 31st of December, 2020. In case the terms are fulfilled and compromise takes place, then the applicant shall be at liberty to file application to make this order absolute. Otherwise the applicant shall be required to surrender before the trial Court on 1st of January, 2021. 4.
The present application is disposed off. However, the liberty is granted to the applicant to file repeat application for regular bail in case future development during period of the current temporary bail are in his favour. 5.
