1. Heard.

2. Learned counsel for the petitioner submits that the petitioner has purchased certain land bearing Khasra Nos. 152/267/2 & 152/267/4 which are situated within the municipal limit Raigarh and adjacent to the aforesaid land, the plot bearing Khasra No. 181/1/Ka situates and the petitioner was in possession of its certain part. According to the policy of the State dated 11.09.2019, the petitioner applied for grant of Bhumiswami right of the said plot, which is in his possession, and was ready to pay the necessary amount as per the State Policy. He submits

that the petitioner had made an application but the same is not being decided instead the respondent State has made a publication for sale of auction of the said plot by Annexure P/1 dated 31.03.2011.

On a query being made to the petitioner that as to how it would be identified that the plot which is subject of auction shown in Annexure P/4 and the plot of which the petitioner is in occupation is one and same. The petitioner would submit that he has made the objection and it is the same plot however no substantial satisfactory answer is given. The petitioner prays that she may be allowed to file a fresh representation so that the identity of the plot which is subject of auction may be clarified.

4. In view of such submission, the petitioner is given liberty to file suitable application before the Nazul Officer so that the identity of the plot is arrived at and if such application is filed, the Nazul Officer shall decide the said application in accordance with law.

5. With the above direction/observation, this writ petition stands disposed of.
