The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 15/2020 registered in Police Station Fingeshwar, District Gariyaband (C.G.) for offence punishable under sections 354, 451 of Indian Penal Code and Section 8 of Protection of Children from Sexual Offences Act, 2012.

As per the prosecution case, the applicant on 11/01/2020 tried to outrage the modesty of the prosecutrix who was minor, thereby offence has been committed.

Learned counsel for the applicant submits that only allegation is to the extent that he caught hold hand of the prosecutrix. He submits that charge sheet has been filed, therefore the applicant may be released on bail.

Learned State counsel opposes the argument and submits that the prosecutrix was dragged by the applicant.

Considering the nature of allegation, charge sheet has been filed

and the applicant is in jail since 13/01/2020, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
