State counsel orally submits that there is delay of 253 days in filing this petition and therefore prays that the delay may be condoned. Considering the submission made by learned counsel for the petitioner, oral prayer is allowed and the delay in filing the petition is condoned. The present petition has been filed under Section 378(3) of the Cr.P.C. seeking leave to appeal.
The petition is allowed. The leave as prayed for is granted. Office is directed to register the case as a regular acquittal appeal. Heard on admission.
